Legislative Summary

S04859 - (retail tobacco shop exemption and preemption) - An Act to amend the alcoholic beverage control law - Advanced to 3rd reading and committed to rules - 2012 Session Adjourned

This bill permits a retail tobacco business licensed to sell liquor on the premises to allow smoking in the same area where the liquor is sold, and supersedes existing local laws requiring these venues to be smokefree. The bill also specifies that the shop must be in existence before 1947 and is open only to members of a club sponsored by the retail tobacco shop who pay a membership fee of at least $1,000 a year, so it appears to be written specifically for one (or a very few) specific business(es).
