This bill prohibits smoking in private and common use areas in high-rise residential buildings--both apartments and condominiums--as well as on private use and common use outdoor areas of high-rise residential buildings. The bill also prohibits smoking in rented single-family residences and rented dwelling units within standard-sized multifamily dwellings, unless a landlord permits smoking through a rental agreement. The requirements do not apply to condominiums if the condominium association’s bylaws prohibit it from adopt rules or bylaws to prohibit smoking.
