This bill repeals preemption and allows for local smokefree ordinances. The bill also amends the Clean Indoor Air Act to eliminate exemptions, including the one for bars, and to prohibit the use of e-cigarettes in smokefree spaces. The bill was amended in November 2015 to permit smoking in gaming facilities and private clubs.

EXEMPTIONS: Smoking will continue to be allowed in private residences except when used as child/adult day care facilities; tobacco shops; a designated outdoor smoking area in a sports or recreational facility, theater or performance establishment; existing freestanding cigar bars and cigar lounges; 25% of gaming facilities; and cigar bars/lounges.
