AB 96 (FAILED)

AB 96 would partly repeal preemption by authorizing local boards of health to enact smoking regulations stronger than state law. This bill would also strengthen state law by requiring restaurants, retail stores, malls, schools, and movie theaters to be smokefree. Non-restricted gaming establishments and bars (establishments earning >50% revenue from sale of alcohol) would be exempt from the stronger state law provisions.
