HB 55-(preemption repeal)-An Act relating to smoking-Signed by Governor

This bill would repeal the preemptive language that prohibits communities from enacting smokefree laws for government buildings.  A policy for smoking in governmental office buildings or workplaces may be adopted by county, municipal, special district, or urban-county governments. The bill was amended to include consolidated local governments.

There is a concern that the bill could be hijacked to expand preemption of all smokefree air laws.


Amended to permit consolidated local governments to adopt smoking policies for local government office buildings or workplaces, and to remove the exemption for state universities, state-operated hospitals, state-operated health facilities, and jails.
