This bill raises concerns for potential preemption of smokefree air laws. It severely restricts air pollution control districts from enacting clean air regulations stronger than state or federal law. Any stronger regulation must be approved by the city or county government, and enacted as an ordinance by a 3/5 vote of the city or county government. A long-time proponent of preemption of tobacco control in KY introduced the bill.
