State Rep. Hugh Holliman, D-Davidson, filed legislation Thursday that would ban people from lighting up in public eateries. The restrictions would take effect early next year, with violators subject to as much as a $50 fine.

“We all know smoking is detrimental to your health,” Holliman said. “And people eating in a restaurant shouldn’t have to be subject to the smoke.”

“People who want to smoke have a right to smoke,” said the third-term lawmaker, elected this week as a House Democratic whip. “But this bill provides that other people will not have to be around the smoke.”
