The Assembly Judiciary Committee decided Wednesday against taking a position on two competing anti-smoking petitions, which means both will be placed before voters as questions on the 2006 ballot.

Under the state constitution, the Legislature had to approve the petitions, circulated last fall, by March 18 or they would be scheduled for the public vote.

The petition that receives the most votes, as long as it is a majority, will become state law that cannot be changed for at least three years.

Legislators still can place a third smoking petition on the election ballot, however.
