Opponents of a strict anti-smoking petition argued Tuesday in court that the petition must be removed from the 2006 ballot because it provides no money for police to enforce its smoking restrictions.
 
Lawyer Kirk Lenhard argued the Nevada Clean Indoor Act petition violates a state constitution requirement that petitions that change laws must include a way of funding those new laws.

He noted that when the Legislature reviewed the petition earlier this month, Las Vegas police testified they would not have officers available to respond to complaints of smoking violations.
