There is a new twist in the debate over smoking in bars and restaurants on Sullivan's Island. Smoking advocates have filed a suit claiming a state law prohibits towns from limiting smoking.

The South Carolina law says smoking is prohibited in ... schools.. hospitals and even elevators. But makes no mention of restaurants or bars. The suit filed by Bert's bar claims the state attorney general has issued opinions three different times about it...

Sullivan's Island Town Councilman Everett Presson reacted to the lawsuit by saying, "We really think that the municipalities have the right and duty to protect the safety and welfare of our citizens. "
