HB4104 - (private club exemption) - An Act concerning public health - Amendment adopted and bill failed to pass Environmental Health Committee; remains in Environmental Health Committee

This bill amends the Smoke Free Illinois Act to allow smoking in a private club that has been in existence prior to January 1, 2008 and can provide written documentation that three-fifth's of its active members approve of smoking on the club's premises. The adopted amendment would exempt private clubs from the smokefree law, but it states that neither the Governor nor any agency or agency head under the jurisdiction of the Governor has any authority to make or promulgate rules to implement or enforce the provision.
