This bill was amended to stipulate that landlords of residential housing can prohibit smoking on the property. Tenants who smoke in their units will be grandfathered by the law and can smoke in their units indefinitely. The bill was amended to remove the provision that would provide that a violation of a smoking prohibition would constitute a material violation of the rental agreement, and a provision was added to allow landlords to establish voluntarily-vacated rent control units as smokefree.
