Cigar bars owners get one more shot to argue against ban

The Nebraska Supreme Court has given cigar bar and tobacco shop owners a chance to argue why they shouldn't have to stop their patrons from smoking indoors.

The decision comes almost a month after the high court's judges declared the state's indoor smoking ban exemptions for cigar bars and tobacco stores unconstitutional.

"We're grateful that the Supreme Court's going to give us a chance to say what we have to say," said Jason "Hutch" Hutchison, who runs the Lincoln location for Jake's Cigars & Spirits.

The Nebraska Premium Tobacco Association, representing a group of eight tobacco shop and cigar bar owners, asked the court for permission to file a friend of the court brief stating its reasons why smoking at cigar bars should be permitted...
