LB118 - (cigar shop exemption) - A bill relating to cigar shops - Signed by Governor

This bill amends the Clean Indoor Air Act to redefine cigar bars as cigar shops, and then exempts cigar shops from the requirement to be smokefree. The Nebraska Supreme Court ruled that cigar bars cannot be exempt from the Nebraska Clean Indoor Air Act. Amendments were adopted to clarify that in addition to cigar shops, hotel/motel rooms, research facilities, and tobacco retail shops remain exempted from the smokefree law. The bill retains the preemptive language that prohibits municipalities from requiring cigar bars, now cigar shops, to be smokefree.
