This bill is preemptive and eliminates the right of county Boards of Health to enact smokefree air laws. Currently, all smokefree air laws in West Virginia are adopted by county Boards of Health. It also requires that the County Commission in all counties that have a smokefree law vote within 60 days on whether their existing Board of Health regulation should become county law.
