HB5289—(workplaces; cigar bar exemption)—An Act Concerning the Department of Public Health's Recommendations Regarding the Clean Indoor Air Act—Session Adjourned

This bill closes loopholes in the state smokefree air law in order to prohibit smoking in businesses with five or fewer employees, in hotel/motel rooms, and within 25 feet of most businesses, except for restaurants. The bill also eliminates workplaces smoking rooms, prohibits smoking in newly constructed public housing buildings, prohibits the use of electronic smoking devices where smoking is prohibited, and allows housing providers to prohibit smoking in rental leases. The bill creates an exemption to allow smoking in tobacco specialists that generate at least 75% of annual gross income from the on-site sale of tobacco products and the rental of on-site humidors.
