Legislative Summary

LB480-(ventilation)-An Act relating to the Nebraska Clean Indoor Air Act-Died

This bill amends the current state Clean Indoor Air Act to prohibit smoking in some public places and workplaces, and restaurants.

  • Preemptive Action

  • Anti-Preemptive Clause

The bill was amended and weakened in 2005 to allow smoking in ventilated smoking areas in public places and private enclosed offices. Smoking is allowed in bars. Also exempt are veteran’s homes, private residences, facilities under control of Health and Human Services, and 25% hotel/motel rooms. Factories, warehouses and similar non-public workplaces must develop rules to prohibit smoking if proximity or ventilation is not adequate to protect nonsmokers.
