This bill makes all workplaces smokefree, and allows smoking in bar areas of restaurants and bars until January 1, 2007. The bill does allow for establishments in existence before January 1, 2007 to seek a waiver if the law will create undue financial hardship. If such an establishment is a restaurant, it may permit smoking in only 25% of the area.

EXEMPTIONS: Tobacco retail stores, cigar bars, outdoor areas of restaurants/bars, hotel/motel rooms, medical research facilities, theatrical productions, private homes. The bill allows for establishments in existence before January 1, 2007 to seek a waiver if the law will create undue financial hardship.
