This bill prohibits smoking in any indoor workplace or indoor public place, including restaurants & bars, or in buses, taxicabs or other means of public transit. Smoking is prohibited near entrances, windows and ventilation systems of all workplaces and public places where smoking is prohibited.

EXEMPTIONS: Smoking is allowed in private residences except during hours of business operation while it is being used to provide child care, adult care or health care; a retail tobacco store; a cigar bar; a manufacturing facility for tobacco products; a state-licensed gaming facility, casino or bingo parlor; an indoor workplace when an integral part of a smoking cessation program; designated outdoor smoking areas; private clubs; a limousine under private hire; 25% of hotel/motel rooms; enclosed areas within restaurants, bars, hotel/motel conference or meeting rooms while these places are being used for private functions not open to the public; and Native American cultural or ceremonial activities. Amended to also exempt workplaces with fewer than two employees that is not accessible to the public and during theatrical productions.
