A statewide smoking ban that a South Carolina Senate panel approved just might strike the balance necessary to get a majority of senators on board, the legislation's sponsor said.

Although details still are being drafted, the bill would essentially ban smoking in restaurants statewide, but bars could apply for a permit to allow smoking.

In addition, communities would be barred from adopting separate, local smoking bans, which proponents of the bill hope settles the legal battles over whether places like Aiken County, Sullivan's Island and Greenville can enact smoking bans tougher than the state law.
