Legislative Summary

HF778 - (partial preemption repeal) - An Act relating to local regulation of smoking - Session Adjourned

This bill would allow cities and counties to enact smokefree laws stronger than the state law for certain areas. The bill states that local governments may adopt laws for "public places or public meetings" which are stronger than state law. However, this bill amends the definition of "public places" so that it does NOT include bars, retail tobacco stores, private offices, residence halls, or any gaming facility. Thus, local laws could not address any of these venues and are, in effect, still preempted from addressing venues not already covered by this law.
