SB419 - (casinos) - An Act Prohibiting Smoking in Regulated Areas of Casinos - Died in House

This bill lays out a process for a committee to determine one of the following by January 2009: (1) an agreement that will facilitate the implementation of a ban on smoking in the state's casinos; (2) substantial progress being made toward the implementation of a smoking ban in the state's casinos; or (3) not resulted in an agreement that will facilitate the implementation of a ban on smoking in the state's casinos, in which case no person shall smoke in any area of an establishment with a permit issued for the sale of alcoholic liquor after February 2009. There are concerns that the bill may not be able to legally address smoking in casinos due to sovereignty issues since the state’s two casinos are tribally owned.
